Starmer: Use the ECHR to Investigate British Troops
Sir Keir Starmer called for the European Convention on Human Rights to be used to investigate British troops in Iraq in a book edited by Phil Shiner, the disgraced lawyer convicted of fraud over false claims of abuse. The Telegraph has the story.
In the book, the Prime Minister accused Gordon Brown’s government of a “deliberate effort” to alter international law. He claimed it had given British troops an effective immunity when operating in Iraq.
Sir Keir’s chapter was published in a 2008 book, entitled The Iraq War and International Law, put together by Shiner, who was subsequently convicted of fraud and struck off as a solicitor over false claims of abuse made against British soldiers.
The Telegraph has also uncovered a photograph of Sir Keir and Shiner speaking at an event in 2014 to mark a European Court of Human Rights (ECHR) judgment.
On Wednesday, Gen Sir Peter Wall, the former Chief of the General Staff, who commanded British forces in Iraq, told the Telegraph’s Planet Normal podcast that it was “shocking” that Sir Keir had linked himself to Shiner, whom he described as “the bane of our lives”.
Sir Peter questioned Sir Keir’s suitability to be Prime Minister, including his power over the military, owing to his involvement in a legal case disclosed by the Telegraph, that led to hundreds of troops being investigated over false claims of war crimes.
The Telegraph investigation uncovered legal documents that showed Sir Keir worked voluntarily for human rights groups on a legal case which ruled that British law applied in war-torn Iraq.
Sir Keir’s spokesman insisted on Thursday that the Prime Minister had assisted the court “on points of law, not to advocate for either side”.
But in the hearing, held before the Law Lords in 2007, Sir Keir, who was representing a series of human rights organisations, argued that investigations into the deaths of Iraqi civilians had been “perfunctory” and “wholly inadequate”.
In his academic article published in Shiner’s book, Sir Keir wrote that ECHR laws were “far more effective” than United Nations international laws, which he argued had been interpreted and developed by the US and the UK to suit them.
“One cannot read key speeches by US and UK politicians and lawyers without surmising that such a development has involved a deliberate effort by the USA and the UK to change international law for their own ends,” he wrote.
““As a result of Shiner’s criminal conduct, thousands of British soldiers were falsely and maliciously accused of war crimes. He instigated a witch hunt based on deceit. The accusations against British troops were totally false, and Shiner illegally pocketed millions of pounds of taxpayers’ money pursuing them.””
The appalling thing is that the depraved criminal Phil Shiner WAS NEVER PUNISHED, never went to prison, and never required to pay back the money he stole from the taxpayers.
It was “Judge” Christopher Hehir who let Catholic criminal Phil Shiner off, which is interesting since Hehir was educated by Jesuits at the Jesuit-founded St. Aloysius College in Glasgow. Networking?
“Mr Shiner, who has been married twice and has five children, claims Catholicism remains an essential part of his life and most years he attends a religious retreat on Iona.” Since there are Jesuit Retreats on Iona, did he join Judge Hehir on some of them?
Whilst I can understand the Judge seeking to remove political principles from the court (eg, bullshit Climate Crisis claims), he has used a sledgehammer to crack a nut. I believe he way overstepped what is acceptable in what’s supposed to be a free country.
That said, ‘Defend our Juries’ seem a bunch of rabid lefties. I absolutely agree we should retain trial by jury as it is, but this organisation would not get a penny from me.
I just looked them up, and you are absolutely right that they’re a bunch of rabid Leftists! I was misled by their name, but in fact they are advocating the jury members’ right to pronounce Not Guilty for a proven crime as long as they agree politically with the criminal!
It’s exactly the same system as in the Third World for “honour killings”, where juries can pronounce the murderers Not Guilty as long as they agree with the religious reasons the criminals committed the crime! Or, in fact, as long as they’ve received sufficient bribe money…
Another example might be the Hindu jury for the Hindu Mob who burned alive the Australian Christian missionary Graham Staines and his two little sons as a Fire Sacrifice to Kali-Allah the Moon Spider Goddess of Death, at the instigation of Hindu priests angry that he had been telling the despised, Untouchable Dalits and lepers that God loved them as well as He loved the Upper Castes, and that their souls, too, could be saved…
Ordered to war under false pretence by a Labour Prime Minister, persecuted through the courts by a future Labour Prime Minister and Attorney General, acting in cahoots with another two-bit human rights lawyer since struck off for fabricating evidence – all from risk-free offices thousands of miles away from mortal combat…

It’s a very un-British thing to do or even consider, but why doesn’t the army stick up for itself? How about next time Starmer inspects some troops, they all do a smart about-turn?
