German Pensioner Receives 75-Day Prison Sentence in Latest Speech Crime Scandal to Hit the Federal Republic
Apollo News is reporting on the substantial speech crime sentence handed to a 73 year-old pensioner from the district of Traunstein in Upper Bavaria. Twice last year, the man repeated the expression “Alles für Deutschland”1 in posts on X – apparently in the course of discussing the indictment of Alternative für Deutschland politician Björn Höcke for the use of the same phrase. The words are forbidden in Germany by Section 86a of the German Criminal Code, which bans National Socialist slogans and symbols. While “Alles für Deutschland” occurs in various contexts, the phrase is associated particularly with the Sturmabteilung, or the SA, who carved the words onto their uniform daggers.
The Traunstein Public Prosecutor brought charges against our pensioner last autumn. The District Court convicted him in November and imposed a fine of €4,500, which he was unable to pay due to financial hardship. Rather than granting the usual deferral or instalment plan, prosecutors have summoned him to serve 75 days in prison instead. He will begin his sentence on June 5th.
This is the latest in a long string of speech crime prosecutions in Germany, as our political establishment collaborates with police and prosecutors to intimidate ordinary people who say untoward things on social media. Last November, another German pensioner from Bavaria had his house raided by police for the crime of sharing a meme on X that called former Economics Minister Robert Habeck a “moron”. Others have been prosecuted for such trivialities as tweeting the poop emoji at a cabinet minister, calling Greens fat and stupid, imprecisely quoting important politicians and reproducing a picture of former Health Minister Karl Lauterbach with his hand raised at an unfortunate angle. In most such cases, convicted speech criminals receive fines (however ruinous), although harsher sentences are not unheard-of.
What makes this most recent prosecution noteworthy, is the fact that the offending tweets were referred for prosecution by the so-called “trusted flaggers” at the creepy government-funded anti-hate organisation calling itself REspect! The EU Digital Services Act has helped empower the schoolmarm scolds at REspect! to police the German internet for “disallowed speech”, and with our Bavarian pensioner they claim yet another scalp. This industrial operation in crying to teacher is headed by a literal Egyptian Islamic scholar named Ahmed Haykel Gaafar, and on their website they claim to have referred nearly 25,000 cases of criminal speech for prosecution over the years.

Still worth opening your mouth even if it means time in the slammer. They want you to be deterred by custodial sentences therefore logically it makes sense to excise your fear of prison in order to fight these people. But you should always insist on political prisoner status when they do lock you up.

A very thorough, honest national police investigation a few years ago found that ALL of the “Tell Mama” hate crime attacks were FALSE. There’s even a website listing such things called “Fake Hate Crimes” at fakehatecrimes.org
Interesting that, in bizarrely placing Muslims in charge of censoring Freedom of Speech, the Communist German government, the result of the Fall of the Berlin Wall, is openly showing its alliance with Islam to destroy the West.
As you know, it’s called “The Unholy Muslim-Marxist Alliance”, or “The Red-Green Alliance” (green representing one of Islam’s favourite colours).
Time for the AfD to REWRITE THE GERMAN CRIMINAL CODE to include an absolute guarantee of Freedom of Speech, essential in all democracies.
The use any so-called prohibited phrase in the way indicated by the article is explicitly allowed by the STGB (Strafgesetzbuch, German criminal code), see other comment. It’s just that the parties governing in Germany care for the STGB just as much as for the Grundgesetz (fundamental law) when seeking to come after those they consider their political enemies, ie, not at all.
Present-day Germany is the open trainwreck of so-called representative democracy. It’s neither representative nor democratic and that Germans are supposed have certain rights guaranteed to them by existing law doesn’t matter when TPTB want to punish them for something nevertheless. The parties rule supreme. Ordinary people are well-advised to keep their heads down lest they be chopped off.
Well that’s good news, and means that the pensioner’s lawyers are useless, and he needs to hire a competent one to point out the law as you just did!
If he cannot afford to pay a €4,500 fine, chances are that he couldn’t afford a lawyer, either. And he certainly cannot a afford a lengthy and principally open-ended appeals process.
A former acquaintance of mine once got fined because of §86a for posting historical photos of German soldiers on Facebook, alongside their private and military biographies. As far as I could gather, the judge simply brazenly declared that posting stuff on Facebook doesn’t count as reporting about historical events and was thus actionable. But there’s certainly no special lex facebook in German law which would back that and if there was, it would certainly be unconstitutional.
But for ordinary people without easy access to professional legal advice, that’s cold comfort as German authorities will readily break any law which gets in the way of “fighting against the right” which they usually consider their overarching objective.

We conduct these discussions with the assumption that things are going to carry on at a similar tempo. The current situation is abysmal. To say that the monetised debt model is dead is an understatement. Large sections of the population have been cutting back on food for a while and now they simply don’t have the money in the bank to pay their bills by a direct debit. Don’t get me wrong I strongly believe that you should never have a direct debit with an energy company. The point we are at now is where the system stops working. All of those things that you take for granted about daily living. Gone in the sense that the resources can no longer be garnered. We shall see what comes out in the wash but definitely interesting times.
Looking beyond the daily grind, so much dysfunctionality is caused by political activists within the political and media bubble. So many school leavers used to end up going to technical college, then work in wealth creating manufacturing. NET Zero is devastating large sections of wealth creating industry and reducing the number of worthy jobs. With the fear and demotivation of recent woke policies and the favouring of victimhood, any remedy is far away.
If those setting priorities don’t understand the wealth creating abilities of Business, or even hate the idea, any prospective wealth creator won’t bother.
It seems odd that “Alles fur Deutschland” is considered beyond the pale but “Deutschland Deutschland uber alles” is the first line of the national anthem. I’m sure the Nazis used the same national anthem.
Don’t expect these things to make actual sense.
The pensioner should have closed every response with “Deutschland uber alles!”.
They no longer sing that first verse. Since reunification, only the third verse is used, the first line of which is “Einigkeit und Recht und Freiheit.”

For hysterical raisins, the so-called state of Germany is saddled with a lot of anti-nazi-laws and politically powerful ‘German democrats’ liberally employ that to go after their political enemies regardless of the fine points of the actual laws.
The important thing about 1984 was that it was Orwell’s idea (or vision) about the likely future trajectory of the Allied powers of WWII based on their post-war actions in the late 1940s. In other words, it depicts what Orwell believe would happen to the antifascism (an originally communist ideology) which had been let loose onto the world.
A particular interesting bit is the idea to control the past by constant rewriting of history whenever the partyline on anything changed. That’s something Orwell must have seen happening, albeit in its early stages, while writing the book.
These words are not forbidden by §86a of the STGB because section 3 of that states

Sections 1 and 2¹ don’t apply if the action was meant for the education of citizens about public affairs, to defend against anticonstitutional activities, for art or science, for research or teaching about research results, to report about current or historic public affairs or a similar purpose.
This is (usually state sponsored) activists and politically captured prosecutors and lower courts colluding to pervert the course of justics to punish Germans for speech crimes the parties behind this (SPD, Grüne) simply made up.
