Pensioner Convicted of Incitement for Posting Negatively About Migrants in the Latest Politically Charged German Speech Prosecution
My routine has been cast into chaos the past several days by builders, so I have only this brief and sad story to offer you, via Peter Hammelrath at Achgut and Ferdinand Knauss at Cicero.
It is about Doris van Geul, a 74 year-old German pensioner who used to have a Facebook account. That is in itself dangerous in Germany, if – like van Geul – you are wont to comment on political matters.
On October 8th, 2023, van Geul encountered an image of our Green Economics Minister Robert Habeck on Facebook. In this image, Habeck was quoted saying that “Germany depends on immigration to meet its labour needs.” Van Geul commented as follows:
Blah, blah, blah. We need skilled workers, not asylum seekers who just want a good life here without respecting our values and culture. Send the ones who are here off to work. We don’t need loafers and freeloaders, and certainly not stabbers and rapists.
For these comments, the Düsseldorf Public Prosecutor charged van Geul with the crime of incitement, and last week, the District Court finally took up her case. The indictment accused her of “inciting hatred in a manner likely to disturb the public peace”. Van Geul responded that she only meant to express her anger at Habeck’s statements, particularly in light of high native German unemployment. She moreover said that she had “overshot the mark” with her words and expressed herself “a bit intensely.”. She even apologised for saying these simple words that, in any sane country, would require no apology.
Incredibly, the prosecutor objected that “it sounds as if [she] still doesn’t approve of [migration] policies”, and, in closing arguments, even opined that her “massive political critique” should increase her culpability. He further argued that her words were “anti-democratic” and could “cause division among the people”. Van Geul’s defence attorney pleaded that her political opinions are widely held in Germany and that “an ordinary citizen must be allowed to express herself in this way”.
The judge then found van Geul guilty of incitement and sentenced her to a fine of €7,950. He said her Facebook comment “addressed… people who have already come to Germany as asylum seekers”, and in this way spoke of “a part of the population… in such a way as to incite hatred”. The judge acknowledged that German society harbours many “fears and reservations” regarding asylum seekers, and also that van Geul’s statement closely echoes “these reservations and the media discourse surrounding them”. He nevertheless asserted that these reservations are “false” – in this way outright denying the objective fact that migrants to Germany do, in fact, stab, rape and draw unemployment benefits at rates far above that of native Germans. Van Geul has the wrong opinions, and she must be punished for them.
This is van Geul’s second speech offence. In 2022, she was convicted under our lèse majesté statute of “malicious gossip against a person in public life”, apparently for merely sharing an article that portrayed Green Party politicians in a negative light. (No details about this earlier case are publicly available; this is van Geul’s own account.) If our pensioner’s conviction is not overturned on appeal, she will likely be paying off her fines for the rest of her life. The poor woman lives on a monthly pension of €1,600, and the €50 monthly instalments will continue until she is 93.

These cases just show that the Fall of the Berlin Wall we all celebrated actually started the Communist East German Stasi conquest of Free West Germany.

That is the chilling thing – perfectly reasonable opinions, shared probably by the majority of her compatriots are sanctioned by huge fines.
Genuinely terrifying.

Interesting detail from the Cicero article: The person who reported this to the police and asked for it to be sanctioned was his Habeckness himself. It can thus be concluded that mere members of the public, especially relatively uneducated ones, criticizing opinion statements of politicians marks them as enemies of democracy and that’s there’s abolutely nothing wrong with a democracy were politicians report those who criticize their opinion statements to the police and make an effort to ensure that they’ll actually be punished.
It reveals the contempt that the credentialled, over-educated establishment has for the general public. They really do think the public is dangerously stupid and needs to be told what to do and what to think. They regard them as too stupid to know what is good for them.
This is not in any way an exaggeration. It is truly what they think deep down and seem increasingly comfortable expressing.
Absolutely. I know a few people like this. They used to think I was one of them (up to a point I suppose I was). When I express certain unacceptable views, they don’t know what to think or say – they have not got me down as an ignorant oik. Probably they just think I have gone mad.
Would’ve thought such intelligent people would also consider locking up people who criticise the Government undemocratic, especially in Germany where there is no shortage of things to refer to.
They were largely happy to see people bullied into having a “Covid vaccine”
Another good reason why anonymity is important.
This article reminds me of the one from yesterday about Derek Heggie, and how it’s now seemingly a crime to tell the truth. He was telling the truth by stating facts about the Pakistani rape gangs preying on vulnerable white girls and this lady is also telling the truth, because migrants have proven to be a massive drain on the German economy, as well as the crime stats supporting her assertion that it’s disproportionately non-natives doing the killing and raping. So how on earth is speaking truth suddenly ”inciting hatred in a manner likely to disturb the public peace”? You know I’m never short on examples when it comes to Germany so here’s a couple. And I note the German police are very much like the British police, in that they release a picture of the wanted perpetrator many months after the crime took place. I see it all the time on Twitter. It’s as if they’re deliberately wanting to give the sleazebags a head start, so fat chance they’ll ever be caught then. To me, one of the worst things about all these cases is the vast amount of time, energy and taxpayers’ money that has to be wasted by police, emergency services, firefighters, hospitals, ambulance staff and medics, social workers, teachers, lawyers, judges, prison staff, immigration authorities, and the intelligence and security services forced to deal with these criminals from Hostile Alien Cultures, who came to the West with no other purpose than to parasitize and thus paralyze the system.

What a load of bull. The defendant killed her because, according to the norms of his culture, she had dishonoured him by treating him in a way no muslim wife must be allowed to treat her muslim husband.
Perhaps the “norms of his culture” developed to justify murder based on “excessive possessiveness and massive jealousy”.
No. That’s the prosecution attorney wrongly framing this in our occidental terms to avoid mentioning the oriental motivations behind this crime. It’s basically a way to “Don’t say Islam lest you commit ophobia!”
Or even release a photo. Lay back and take the gang rape for diversity. A labour MP mentioned something similar.

No. That’s what happens when ordinary citizen dare to cross leading Green politicians. As the Greens are all so much democratier than any ordinary German could ever be – probably a Nazi, anyway, especially if critical of Green immigration policy – such people are enemies of democracy of must be persecuted with all the might of the state (coincidentally, controlled by these Green politicians and their sort-of-red cronies).
If anyone is dangerous in this story it is the judge. She has done more damage than anything that this pensioner posted. All this is going to do is drive more people towards the parties that state they will address such issues, now called the right wing parties, but, in so many ways, are purely the parties of common sense and increased free speech.
They are trying to ban the AFD as if just by doing that, all those people with ‘nasty’ opinions will just go away.

What a sanctimonious and chilling comment. I hope that a diverse range of new Germans, moves into the prosecutor’s neighbourhood. He can then enjoy the benefits of a full range of cultural differences.
They are never anywhere near those areas, but they can always take a wrong turn one day. This judge is the lowest of the low and would not piss on her if on fire!
It would have to be Germany. This country was doing so well after the war. It became the economic powerhouse of Europe. The people prospered and all was well. Germany is a beautiful country. I have been to places like Heidelberg, Mannheim, Trier, Bad Kissingen, etc etc. I was impressed. —Now not so much. When people cannot speak freely about political decisions, eg mass immigration, then they are no longer FREE. We thought it was bad in the UK, but what is happening in Germany is a diabolical disgrace.
Yes we had a great family holiday there around 1990/91. Went on a boat along the Rhine and remember the town of Koblenz. Also visited the Hofbrauhaus then went on to Austria in Alpbach, popular with tourists during the Ski season.

Fuck me, so now it is illegal NOT to agree with mass immigration policies. Why not pick a city, and work in every geographical area like a Postman, knocking on doors asking their opinion on immigration and have a van waiting for those that are against it.
