“Show Us the Data”: High Court Demands Austrian Government Justify COVID-19 Restrictions

Austria’s powerful Constitutional Court has demanded detailed data from the Government Health Ministry justifying the coronavirus response. News.com.au has the story.

The 14-member court issued 10 sets of questions to the Health Ministry on January 26th in order to prepare for a “possible oral hearing” into a number of complaints it has received against Austria’s COVID-19 measures.

The Health Ministry has until February 18th to respond.

Austria plans to ease some restrictions from Tuesday as its nationwide vaccine mandate, the first in Europe, comes into effect.

But in order to justify his Government’s heavy-handed rules, the court has asked Health Minister Wolfgang Mückstein to provide data across a broad range of topics including hospitalisations and deaths ‘with’ as opposed to ‘from’ COVID-19, the efficacy of masks and vaccines, and evidence supporting the now-rescinded ‘lockdown for the unvaccinated’.

“The ‘lockdown for the unvaccinated’ is likely to be based, among other things, on the consideration that persons without Covid vaccination have a higher risk of hospitalisation than vaccinated persons, which is likely to entail a higher risk for the healthcare system,” the court wrote.

“What is the effect of the ‘lockdown for the unvaccinated on the hospital burden, expressed in percentages?”

The court asked for information on which virus variants were associated with these numbers, a breakdown by age cohort, and for “percentage allocation” outlining where infections occurred, such as family, work, shopping or leisure activities.

Another question asked, “By what factor does wearing an FFP2 mask indoors or outdoors reduce the risk of infection or transmission?”

A number of other questions related to vaccines, with the court requesting data on their efficacy in reducing severe illness, preventing transmission, and the durability of protection.

“By what factor does Covid vaccination reduce the risk of severe disease?” the court wrote.

“In media reports, there was talk of up to 95%. Now, the general risk of dying from Covid-19 (not differentiated by age and health status) currently appears to be 0.1516%.

“What does a stated vaccination efficacy of, for example, 95% refer to? What do absolute and relative risk reduction mean in this context?”

The letter also requested the Covid-related hospitalisation risk over a one-year period for an unvaccinated 25-year-old compared with a double-vaccinated 25-year-old, and the same for a 65-year-old.

It concluded with a question about Austria’s excess mortality statistics.

In December, the Der Standard newspaper reported that there were one-third fewer COVID-19 deaths in 2021 compared with the previous year, but that weekly excess mortality was higher.

“Is this true?” the letter asked. “If so, what was the total excess mortality in 2021 that could not be explained by COVID-19 deaths, and what is the explanation for this excess mortality?”

Austria has seen record high case numbers in recent days, fuelled by the Omicron variant.

Good to see a high court taking a detailed interest in these technical questions, unlike our own largely supine and deferential judiciary. Also good to see an interest in the unexplained wave of non-Covid excess deaths this winter. The Government’s response will be interesting, as will the court’s ruling.

The data baby is malleable and can disappear in an instant.You have to understand what they were doing – they were measuring responses and this situation suited their objectives rather well and still does. Big countries with small populations – attack more and find the limit. In terms of money it has already gone forever given the wealth transfer to the one percent. In a sense they got away with it. My feeling is that they will not get away with the next few months. Not much you can say to ameliorate a mass die off it will be like the plagues of Egypt.

You might despise a coward but you would still protect him if he was in trouble. On the other hand their cowardice has led to the slaughter of uncountable numbers.

I can forgive someone cajoled into being injected. I somewhat respect the double jabbed who refused a booster once they realized things were not as advertised.

However, the majority of those around me gave the matter virtually no thought. Most people in my circle got injected so they could book a holiday. I strongly suspect some had their teenage kids jabbed for the same reason, so as not to upset travel plans.

It is that latter group that worry me. Zero critical thought.

I know what you mean. Their main concern was material hedonistic satisfaction. For those people I have no love or sympathy. And I know very well where they will end up. At least if nothing else this was a litmus test – you found out who the true mensches were. People who don’t have anything in particular in common but nonetheless we felt it was out duty as human beings to examine the reality. Many will disappear unfortunately. Hopefully those of us who will be left behind will come up with something better.

It’s hard, though, when it concerns people you’ve known all your life – close friends with whom you’ve shared so much and who have become abusive and accusatory when hearing you’ve refused vaccination. Apparently I am a moron for remaining unjabbed (I didn’t mention I was unmasked as well, she would have been apoplexic).
When you’ve been close to someone for 60 years you think you know them, then this unexpectedly happens and you realise that perhaps you didn’t know them at all. I greatly miss my friend, and knowing that she is not the person i thought she was I went through a kind of grieving process, albeit mixed with anger.

I know people who have had their kids jabbed – so that they could ‘participate in normal life’ – go to birthday parties, scouts, football practice…. knowing their plans there was no way I could share with them my concerns and what I knew. It is their decision. I worry about their futures.

I know people who’ve done more research and put more thought into buying a new kitchen appliance or steam cleaner than a novel medical treatment that they’d be putting into their or their kid’s bodies. They’re so thorough when they read reams and reams of reviews on Amazon! It’s as fucked up as it is scandalous.

If you don’t want to travel to other countries don’t get jabbed. You won’t have a valid ‘Vaxx Pass’.

It’s wrong, but there you are. ‘The lawyers’ of your imagination have not prevented this from happening, ‘Nuremburg 2’ hasn’t been slotted into any court appointments yet.

My take is that this pandemic has taken them as far as it can take them. They are happy to bank the numbers vaccinated to date as enough to make the vaxx pass a way of life and might regroup for another crack it by releasing another virus.

It is the only way I can view the country by country unwinding almost in lockstep, as if the order has come from a bunker “abort abort abort” because Omicron is now so weak that if they continue it risks exposing the fraud.

It is astounding that it is a novelty to see a judiciary asking these forensic questions, which should be the nub of any argument.The common test of ‘reasonableness’ and proportionality should be at the heart of any judgement, but hasn’t been so.

Good point. We’ve become so inured to the notion of an establishment or self-appointed elite we are shocked when people do their jobs.

Maybe that’s the real lesson of the last two years. Our Majesty’s opposition opposed nothing. In most votes about five percent of MPs questioned or opposed the government’s narrative.

The few media types like Laurence Fox asking fairly normal questions about what is going on were seen as unhinged lunatics.

All those questions should be noted by someone on our side and developments monitored with a view to the inquiry the UK government has promised will be held to ascertain what was done in the UK.

You can bet your bottom dollar that someone on the inside will be watching very closely to see what the Austrian government feeds into that hearing.

Easy answer to your question : they were following orders, as were courts everywhere in all countries.

Very few countries courts, with the exception of Spain and Portugal that I know of [perhaps others can add others], were prepared to challenge the narrative.

This is a story to follow… the questions are unanswerable in an honest and open fashion – doubtless they would have obfuscated to their hearts content but it seems the old absolute vs relative risk reduction trick is out of their arsenal… keen to see how it will be pulled apart by the so called fringe minority online who are so much better with data than the elites.

I think of it as a mental physiological one. I have known a couple of people who took the mark and they are more angry and irritable than ever with a diminished capacity for beauty and morality. This is a stab in the heart of the evoulution of the human spirit we should never forget that. The mystery schools warned about this period from 2020-2040 and the dangers of us falling into the eighth sphere.I am more confident than ever that we will overcome this.

We are a rather jaded population. For example it is difficult to imagine those holy roller American preachers gaining traction over here because we would just take the piss. On the other hand millions of boomers listen to the BBC like it is God. There is still a spirit left in this country beyond all that and we need to find that among ourselves.

Most revolutions are driven by tiny numbers, supported by a larger number who broadly agree. The active component is often small.

I think we are there. I suspect the issue is people don’t publicly see or hear much dissention, even though they’d probably agree with dissenting voices.

There is a reason they obsess over the narrative and expend colossal sums to control it. It is also why one really first-rate meme taking the piss works so well. Well enough they’ve begun legislating against them in Scotland. All that harmful hate speech and misinformation has to be eradicated.

First of all the court aren’t asking for a case to be made about reasonableness – it’s narrowly asking for the data. Unless the whole report here is wrong. So it’s an appropriate headline.

Secondly I don’t feel Billy-big-balled about authority at the moment, with various precautionary principles applied unreasonably to me and those I know after the last two years. I feel quite disempowered and emasculated. I’m sure that women feel dehumanised to. And so we fight, and so I don’t think most of the writers here feel powerful. We’ve almost been forced to beg.

I recognise the government could fudge it but I’m hopeful the judiciary will scrutinise it and award the other way if they’ve not put the effort in.

Close to ideally would be peer reviewed studies (on masks for example) with expert witnesses able to challenge with other peer reviews.

I recognise for example that peer review may well not be available for many things including masks (someone point me to one if there are) and non peer reviewed studies being presented will only play into the claimant’s hands if they’re any good

Stop getting hung up on ‘peer review’. Peer review is pal review, which is open to club members only. Vast majority of the worlds scientific discoveries were made by people who did not go through any peer review process.

You have to put it all into the equation aside from the military. We are not moving into a position of strength whichever way you slice it. A vaccine injured 18 year old costs about 5 million for care until the end of their life. That is a small matter but the general principle prevails. We will be so encumbered with injury that we will not even be able to cope with that. Warfare requires serious appraisal of the situation. Very few people want to be adults anymore and stare the cold hard truth in the face.

If your scenario is true, and we see mass injury, I can think of no faster method of making the masses into the adults you claim they don’t want to be. A very hard dose of reality indeed.

But I concede the point and I too despair when I see even people in their 40s and 50s call upon the government to guarantee everything from the right to a house to everlasting happiness.

Lawyers for PHMPT, in a brief submitted Jan. 25 to the court, asked Pittman to reject Pfizer’s motion and requested the judge ask Pfizer to clarify how, exactly, its intervention would help expedite the release of the documents, arguing that Pfizer:
“… provides no reason why it needs to intervene in this matter to render that purported assistance. Nor can Plaintiff discern why Pfizer needs to intervene in this matter to assist the FDA with expediting release of the requested documents—it can render this assistance without intervening.”
PHMPT, a group of more than 30 medical and public health professionals and scientists from institutions such as Harvard, Yale, and UCLA, in September 2021 filed a lawsuit against the FDA when the agency denied its original FOIA request.
In that request, PHMPT asked the FDA to release “all data and information for the Pfizer vaccine,” including safety and effectiveness data, adverse reaction reports, and a list of active and inactive ingredients.

Well, should not hope for much. Here a view from Austria where I am (unfortunately) living… mainstream media have already attacked the Constitutional Court, main reason being: the question list was submitted by one judge nominated by the scary FPÖ …sure they don’t dare going full-frontal “antivaxx neonazi etc…”… just suggesting…as usually here and elsewhere. the original list of questions does in fact really look as a compilation of “antivaxx. antimask, antilockdown” arguments…to the point that when the questions list started to circulate on the net here, everybody was wondering if it was not a fake…until the Constitutional Court confirmed however apparently mainstream media just discovered such arguments…yet again medias don’t dare to use the dreaded word “antivaxx rhetoric”, headlines state “the Court asks tough questions” now the way it works in Austria ensures it won’t change much: i.e. by time the Constitutional Court comes up with some decision (usually against the gov), the government would have lifted the measures : previous measures back in 2020 and early 2021 were also deemed unconstitutional AFTER gov lifted them. so as that’s common practice, it’s like a game: gov implements anticonstitutional measures, somebody brings the matter to the Constitutional Court, they ponder… Read more »
