Germany Scraps Free Covid LFTs, Pushing Unvaccinated into Getting Jabbed
Germans who have not been vaccinated against Covid (or have not recently recovered from the virus) must now pay for tests in order to attend public gatherings, with free lateral flow tests having been scrapped by the Government. Added financial pressure is expected to nudge those who have decided not to get vaccinated into abandoning their positions. The Guardian has the story.
Public gatherings across Germany have since August 23rd been allowed to go ahead if they follow the so-called “3G” rule (short for geimpft, genesen oder getestet), meaning participants have to show proof of either vaccination, a recent recovery from the virus, or an up-to-date test result.
A large-scale infrastructure offering free Government-subsidised rapid antigen tests that sprung up across Germany over the spring and summer made testing part of people’s everyday routine while vaccinations were still hard to come by.
But as of October 11th the Government says it can no longer justify paying for free tests out of the public purse since all residents over the age of 12 can now get the jab if they want to.
The hope is that the cost and inconvenience of paying for coronavirus tests will help to boost Germany’s stagnating vaccination rate, a problem politicians did little to address while the country was locked in election campaign mode.
Similar plans are being drawn up in England which could push the unvaccinated to get jabbed if a similar vaccine passport scheme is introduced later this year.

Greetings from Hamburg. As of 11th October 2021 germans must pay for the previously free later flow tests as part of the government 3G policy. 3G means Geimpft, Getestet or Genesen (Jabbed, Tested or Recovered). Government recommended price for the test is euro29. As the 3G name implies testing is not necessary if you have been jabbed and also not if you have recovered within the past 6 months. Testing is also not necessary for shopping but is necessary for bars, restaurants, swimming pools and all other social venues, but not places of worship. In addition various federal states are allowing venues (again down to the restaurant type level) to decide for themselves to impose a so called 2G policy, meaning that regardless of test status only recovered or jabbed people are allowed inside. Venues imposing the 2G rule are required to display a prominent sign outside (usually involving a somewhat sinister image of a syringe). I can testify myself that it is surprisingly unpleasant to realise you are excluded from entry to a venue based solely on your medical history. As can be expected by a country which was militarily occupied for about 50 years, mainly by Americans (still present, although that’s more or less symbolic), successful German politicians always voluntarily inflict everything on the German population (larges parts of that being considered the enemy by said politicans) whatever their American overlords also inflict on their population, usually in a more zealous way as they’re not constrained by any domestic opposition.
Now, the current crop of US rulers (in many places) don’t think all these funky international laws which were invented post 1945 in order to find a reason to execute Germans really also apply to them. But that’s not exactly surprising.
I am German and moved to England more than 20 years ago, yes, one big reason was that I did not like the German love for authority.

I think unless you lived in Germany for longer, especially when it was still 2 Germany’s, and experienced the two countries and coming together and especially ordinary people trying to make sense of it all and try to become one nation, you cannot judge what is going there.
Germany has often been described as the powerhouse of Europe, mainly in connection of the economy, but it also was, due it’s location and when it was still 2 countries in a unique political situation, being in the middle of the USA and USSR.
I am as surprised and frustrated as anyone why the Germans have been so quiet recently, but I do believe the opposition there will rise and and change will come.

The present domestic policy in Germany mirrors the domestic policy of the Democrats in the USA and of similarly USA-influenced countries world wide. Hence, Americans (most likely) running around – as they always do – randomly referring to Germans as Nazis because they’re following – as they always do – an American lead is highly inappropriate.
My oldest friend lived in Germany for many years, and also married a German. Her father was a senior officer in occupied Slovenia during WWII. I have thus had a lot of conversations involving the issues around the War, the associated ramifications (including guilt), and the nature of post-war development.

The only surprise I currently have – after all those conversations over the years is how easily Germany has succumbed to the new totalitarian malaise – probably more of a surprise than the experience of watching the UK losing its self-satisfied fascist virginity.
Germany is a partially sovereign state whose foreign policy is to be controlled by either NATO or UNO. As if it was 1949, the German government’s most important domestic occupation (according to its own statements) is fighting nazis conjectured to lurk everywhere in the population, especially insofar the population is critical towards government Corona policies. People who are are being observed by the domestic secret service (Verfassungsschutz) on behalf of the former GDR state party in Berlin (nowadays called Die Linke, part of the ruling coalition there).
Why wouldn’t a German government slavishly implement anything an international expert body like the WHO wants, especially, if that’s what it’s US allies (sarcasm) want as well? The whole notion of the post-national German paradise-on-earth state (according to its ruling elite) is built around that.
I second that – I love Germany and its smart and dry humoured people – there is enormous resistance to this global over reach – all the best to our German friends x

What I find astounding is that they keep on pushing the ‘vaccinate’ agenda even with mounting evidence of the vaccines being at best useless at controlling the spread of covid, and possibly even increasing the risk of infection and thus increasing risks to the vulnerable.
The courts seem to be unwilling to accept scientific evidence over the belief in the vaccines. I’ve no idea why this is — the evidence of their lack of effectiveness is becoming overwhelming.

Over the past 18 months numerous court cases have been brought in the Netherlands. As far as I know, in just about every single case the court has refused to look at even the basic merits of the case and every single time said that in dealing with the pandemic the government had a lot of latitude (no kidding!!) and was acting on the advice of the Outbreak Management Team and that was good enough for the court. Numerous violations of the constitution – not a problem. Flawed emergency regulations – no worry, court was happy to allow the government to get away with it. No evidence that any of these measures did anything besides cost the taxpayer 81 billion euros? So what, at least they were doing something, pointless action is more important than meaningful outcome.
It would appear that the majority of the courts in the Western world have abdicated any sense of responsibility in keeping governments in check.

Of course. But that is no excuse for just about every single judge in the Western world to be going along with this. Even for those that fall for the propaganda, some of them should still realise the role of the judiciary in the separation of powers. Some of them should at least be willing to look at other arguments, particularly when a caretaker government (resigned last January, due to big egos still no new government since the elections in March) is committing such egregious and flagrant violations.
The role of the judicary is to determine whether or not something is formally correct with the letter of existing law, not with its (likely) intent and also not, if it makes otherwise sense (in a system that’s not based on common law). If there was a parliamentary vote that it’s OK for the government to violate the constitution, no judge can do anything about that even if he happens to be unconvinced of the reasoning behind this.
To use an example from another domain: Tax evasion by ruthless exploitation of whatever legal loopholes are available for that is usually legal until it’s explicity outlawed by new legisation (with its own set of loopholes).
The current situation in much of the so-called western world is very much governments operating with the mindset of a professional tax avoider: A set of political goals is compiled, eg, vaccinate everyone. Then, people start searching for whatever they can legally do to get this done despite it’s supposed to be formally impossible.
A grounded perspective. There is often an overestimation of what the law can do, regret it as we may.
But it’s ultimately the law that we have allowed.
UK judges do not sit in judgement free of charge or pro bono. They are paid from the taxpayers’ public purse and, in common with many other parties (medical, political, media via vast Government advertising spend, inter alia) this generous money supply is irresistible and, like any drug addict, they are so hooked on it that they will do or say anything to keep up the supply, including maintaining their Government paymasters’ narrative and propaganda. Venality is ubiquitous here, and the main difference now is that there is not much pretence at hiding it.

Yes. The judiciary aren’t perfect. But the primary criminals are the electorate : they gave power to a group whose scorn for rational due process and honesty was obvious.
Democratically uncomfortable – but true.
You forget that the judges’ role is not to interfere with the executive or curb it; it is to apply the law. When the law itself is atrociously bad, an objective judge cannot do anything but go along with it. The single exception are those few judges tasked with determining the law’s compatibility with the constitution. But once this hurdle is taken, you can have any sort of immoral law passed through the parliament (or as may be, through executive to which the parliament “lawfully” delegated its responsibilities), and the judges will just defend it – because that’s their role.
Shortly, when the law is fucked, you are fucked and everyone else who falls under its jurisdiction because the enforcers have more guns than you. Many people don’t seem to realize this very basic principle – lawful never meant “good”.
But this is uniformly happening in every country across the world – other than Portugal, and Spain, where there have been some victories, courts are not responding to ‘covid’ litigation the way they would to other aspects of state over-reach – where they would consider the case fully, on its individual merits, and examine the evidence. The courts on an almost worldwide basis have abdicated their responsibility, kind of ceding it back to the national government, in a way which has no former precedent. As if someone at some kind of supranational level has decreed it should be this way.
No doubt, some have had a price that has been met.
Abdicating any sense of responsibility might be taking it too far. They perhaps still have a sense of what’s right, but are frightened cowards. Look what has happened this year in Germany: judges ruling against the executive have had their homes raided and searched, and their electronic devices taken. Likewise attorneys representing those seeking judicial review. They are being persecuted. Germany is sliding back fast to the 1930s, or Zimbabwe under Mugabe in more recent times.
You can’t expect the judiciary to make fair rulings when it has massive interference from the executive as US Supreme Court Justice A. Alito Jnr, remarked to the 2020 National Lawyers Convention, November 12, 2020:
Fair enough, but such a situation is most unlikely to occur here in NL (or in Germany for that matter – I know pressure has been put on judges there, but a tank at the door seems unlikely). Last January, imo under pressure from Brussels, the OMT advised night-time incarceration of the people, in direct violation of the Dutch constitution. At no point prior to that time had NL engaged in any of the extreme measures being taken across Europe, the approach here far more resembled that of Sweden. This was taken to court and the district court did in fact hold that the law/regulations on which the incarceration (sorry, curfew) was based was wrong and the government was at fault and the curfew was to be lifted immediately. The court of appeal immediately set aside that ruling, something that does not generally happen with regard to injuctive relief, held an emergency appeal 2 days later and then stayed its decision for a further 7 days, during which time the government had the opportunity to ‘fix’ the law. In the UK they have adopted a euphemism for such certain psychological tactics: ‘nudging’. You can nudge someone to do something that they would otherwise not wish to do by generating fear of the consequences of not complying. No pressure then!

I honestly doubt there are many in the Dutch judiciary at least (in contrast to the Spanish and Portuguese, where there are still some judges willing to take the government to task) who even understand what their role is in terms of checks and balances. Check out the decisions in the Urgenda case (Dutch Supreme Court) and the district court decision in Friends of the Earth v Shell of last December. Both climate change cases, where the courts took it upon themselves to make actual policy – not apply law, not interpret law, literally make law (this is not a common law system). This was clearly the agenda of the judges and the decisions were based on tenuous legal grounds imo. I’m sure significant pressure was exerted on the judges at the time, as the Urgenda decision has caused no end of knock-on trouble for other, more important and certainly more pressing policies of the government. Correct. This is a sham and not a genuine consultation. It is framed as a fait accompli for vaccine passports exclusively, with the only things being ‘consulted about’ being the details of how broadly it should be applied – whether the list of venues should be expanded. It is an utter disgrace in a so-called democratic society.
For example, one of the questions (which are multiple choice, and so restrict the answers) asks who should be required to use vaccine passports: the vaccinated, the unvaccinated, ‘don’t mind’ or ‘don’t know’. The ability to answer ‘no one’ or ‘none of the above’ is not an option. No one is going to ‘tick’ ‘unvaccinated’, a tick for ‘don’t know’ won’t count, and ‘don’t mind’ will be taken as vote of support for introducing them for the vaccinated.
And thus it is completely rigged.

Clearly the people who put this ‘consultation’ together knew exactly how to stack the deck to get the result they wanted.

I’ve managed to survive in Germany all this time without taking a single test of any kind nor buying/making a single mask (I’ve got 3 of them for free, and I’m still reusing the first one when forced to, fully aware that it does nothing, and illustrating the utter idiocy of mask mandates that can be worked around by anyone so inclined).
So I don’ give a horseshit about these new regulations nor price increases, not intending to spend a single Euro myself in support of anyone who demands them or checks any vaccination passes.
